Legal Question in Credit and Debt Law in New York

What is the legal age range for filing for bankruptcy

Our 18 year old son was given a checking account with $200.00 (Two Hundred) in it. He then proceeded to write checks totaling over $14,000.00 (Fourteen Thousand) within a period of 4 weeks. He is still in high school and can only work a few hours part-time. He does not want to leave the high school, test for a GED and get a full time job. Due to his consistent pattern of misbehavior we are making him fully accountable for his actions. His creditor is the Military Exhange System. They allow only 12 months for repayment which he will never meet even with two part-time jobs.

We advised him to file for bankruptcy. Can he file and if so how should he proceed?

Bankruptcy is not a good idea. In fact he may not even get a discharge from the court, since he wrote the check clearly knowing he did not have the funds.

You son is facing a potential criminal offense (this is VERY serious). It is best that he works out a deal that he can satisfy so they do not file criminal charges against him for writing a bad check.
