Legal Question in Credit and Debt Law in New York

I mistakenly took out a loan with Western Sky Financial a "tribal nation" out of South Dakota who within one day sold the loan to Cash Call who is located in California, I live in New York. I did default on the loan I had an "attorney" call me today and told me that Western Sky wants to try me in criminal court for breach of contract for not paying my loan. Can they do this, if every person in America went to jail for owing a debt there would be millions if not billions of people in jail, thank you for your time

This is a bunch of nonsense, the collection agency is using a scare tactic in violation of the law, there is no criminal prosecution for a debt. They can only sue you in civil court for the outstanding balance.
