Legal Question in Credit and Debt Law in New York

Opening a joint checking account

Hi..My question is: I have a money judgement against me for an un-paid hospital due to lack of medical insurance. All of my bank accounts (in my name only) have been frozen. If I were to open a joint checking account with someone else's name, plus mine, can they still legally ''freeze'' this account too? I was wondering if that would be safe and un-touchable because of another persons name on the account with mine.....Thank-you very much for your help Kathy

Kathy:

No, that is not safe. They will freeze that one too and your joint tenant will have to prove part of the money was theirs. No good.

If they are within the statute of limitations and you were properly served with the claim, why not settle it and pay monthly?

Feel free to email me to discuss further.

Re: Opening a joint checking account

Any account with your name is attachable. There is a presumption that all joint accounts are 50:50 with each person having a right to use the whole amount.

Good Luck
