Legal Question in Credit and Debt Law in New York

where to report abusive collection agency creditors

Hello, tonite i was harrassed terribly by someone from a collection agency. I was screamed at and treated abusively by this person who did not allow me to speak, but screamed out in a psychotic tone about the $2000.00 credit card debt i owed.

I must mention that i am a very passive person by nature, and did not raise my voice at all to encourage this treatment.

When i attempted to try and report this person to someone in their agency, i would assume a manager, i was also treated badly by this person.

The whole experience has made me ill.

Is there someplace i can contact to report these men? I do have both their names.

I thank you for your advice, it is greatly appreciated. And i commend your website for all the help you give.

The (Federal) Fair Debt Collection Act governs the behaviour of debt collectors. What happened to you is completely unlawful. You should report them to the FTC. They have a web site w/an on-line complaint form. Next time they call you tell them they are NOT to call you anymore. If they continue to harrass you, you may bring suit against them.

That sounds like an awful experience. There are laws against that behavior; however the government will rarely take any action. The Better Business Bureau is not a serious agency. Reporting it to your state senator or assemblyman requesting assistance is a better option.

If you have a witness or a recording of the abusive behavior then the Fair Collections Act will help you.

If you like, you can fax (718) 729-2029 or email [email protected] the information (your name, name of agency, dates, etc) and I will be happy to write them a strong letter. that would likely prevent recurrence of this abuse. There will be no fee.

In addition, you are welcome to a consultation on this or any other matter at my offices at 42 West 44th Street for no fee. Please call for an appointment first; (646) 591-5786.
