Being sued by a school

I am looking for assistance with a school that is suing me for $22,000. My son was going to attend the school and I was given a scholarship for $16,000 and was to pay only 6K. I learned that I was about to loose my job and was not going to be able to pay the school. I notified them too late which is why I am being sued for the full amount. I have been to court two times already.

1. I was told that I need to have my EBT which was requested. I have no idea what that means.

2. I need to know if that amount (22K) should be in the Supreme Court. Someone told me it has to be 25K or more.

3. I have an appt to have the EBT done before October 3rd - I am looking for assistance with that.

4. It's in Nassau County.

5. The crime is I didn't notify the school early enough which should have been in March. I told them in September and my son is now in public school. Never ever attended the grade for which I am being sued.

An EBT is an Examination Before Trial, also known as a deposition. You will be asked questions about the case under oath. You also have the right to depose a witness from the plaintiff on the same day. Depending on how the deposition was scheduled, you may have to give them ten days notice if you wish to do so. If the deposition date was set at a Preliminary Conference, then usually each party will depose the other on the same day.

The lower limit in Supreme Court is $25,000. The County Court has jurisdiction of cases between $15,000 to $25,000. You have to bring a motion to have the case removed, or the Supreme Court may do so on its own.
