The law is extremely straight forward. The potential punishment is

As well. On murder in the second degree there are only two options

For punishment, 15 years to life OR 25 years to life.

The decision between the two options is based on the egregiousness

Of the crime itself, and decided by the judge, if the defendant is

Found guilty. In a case where the victim was a pregnant woman the

Likelihood would be for greater punishment.

In ny given the state of the parole board on average the amount of

Time served on a 15 to life sentence is 20 years, and on 25 to life

30 years.

Essentially the elements of the crime are an intent to cause a

Death, and then causing the death.

In most circumstances it could be plead down to manslaughter in

The first degree, where the sentencing options are much better.
