Legal Question in Criminal Law in New York

How would I begin an attempt at a retrail on a case that was orginally a bench trail and has recently become an appeal that was denied. There is no proof that the individual is guilty of this crime. The servallence tape was thrown away by the prositcution prior to trial, thus giving the defense no oppistion to the charges alleged by unsavory charactor. Whom was the only alleged witness and the likely culprit. This individual was coerced into a bench trail by his initial leg al council and has since been condemed due to it. There is no doubt that if a jury hears the facts of the case from both sides that he will be aquitted of all charges. My question to you is how do I get the ball rolling. What is my primary step in intializing a retrial, with a jury.

I dont think there is any hope or avenue of retrial considering the appeal was denied.
