Legal Question in Criminal Law in New York

my boyfriend was just arrested last week in Queens ny and was charged with CPCS 3rd degree, CPCS 4th degree,CPCS A misdemeanor, and attempted tampering of physical evidence A misdemeanor. He has a $10,000 bail but told me not to bail him out because his lawyer said she can get him an inpatient drug treatment program. He goes back to court 3/3/10 to get evaluated for the program. He just completed a inpatient drug program in 2007 and already has 1 felony conviction. My question is can he get this program or is he in more trouble than he thinks he's in? plus she's not a paid lawyer and im not sure of exactly what took place for him to have gotten arrested all i know is what im telling and asking.

There are new laws which make it easier to get drug treatment programs. It would depend on his prior criminal history as well as his current charges. If he does not get the program or disposition he felt he deserved, he does not have to plead guilty. He can always discuss his options with another attorney. Most will give a consult free of charge.
