Legal Question in Criminal Law in New York
Burglary & Grand Larceny
My fiance made a bad mistake and when he was retained by the police he was honest and served an overnight stay in prison, he spoke to the judge and was honest he has not prior felonies or anything prior but a DUI. I was curious if it is possible to get off with a community service or high fines for this charge. The judges dropped is from a class A to D because he believes my fiance. The house was not broken into he knew the person and the car that was taken was returned right where it was left. What can I expect?

There is not enough information in your question for me to answer your question. A house burlary is considered a violent felony in NY, which, of course, is a serious matter, but you indicate there are other circumstances that the judge has become aware of which might help your case.
