Legal Question in Criminal Law in New York

I have been charged with criminal sale of a controlled substance in the 3rd degree, I was arrested in a bar toilet. I have two previous possession charges and did a short stint in jail for the second one. What would be the expected jail time for this charge, given my background? From what I read online it could be anywhere between 1-9 years.

Are you charged with a felony or misdemeanor?

I recently had a client arrested for possession with intent to sell (a felony) under similar circumstances. A security guard peered over the bathroom stall and saw my client will pills. He was detained when he came out of the toilet and arrested. I was able to convince the DA that my client was not selling and get him an ACD.
