endangering welfare of minor

our 16 year old son who was left with neighbor for a weekend. He snuck back into our house while we were gone, invited friends over who in turn invited their friends ++ aged 16 & under & also brought alcohol to our house. Police came into house and asked owner, arrested our 16 year old son & sent other kids home. He was charged with section 260.10 endangering welfare of child. Can 16 year old be responsible of other minor's welfare? Why was he only one charged? They also refusedto hand him over to the neighbor who was left to be in charge of him. Is this legal?
