Legal Question in Criminal Law in New York

Extradition

My husband had a warrant out for his arrest for aggravated assault in the state of Vermont. We moved to New York not knowing about the warrant. He was jailed for thirty days per his sentence for breaking and entering 3rd. What will the extradition process be for him? Will he be released on his own recognaissance or will he be held in the New York jail until the Vermont police come for him? Does the state of New York have the authority to hold him even though his sentence is finished?

Yes the state can hold him pending the action of the Vermont authorities. Your BF should waive extradition and your attorney should pressure the Vermont authorities to come and get him or get a waiver that will allow him to come in and surrender.
