Legal Question in Criminal Law in New York
file a motion for reinditment to have my attorney present
was indited without my public defender, have 45 days to file motion for reinditment/w/attorney/can't speak to my attorney how do i file this motion on my own jan 6 is the 45 days

most courts strike any motion submitted pro se when there is an attorney assigned. you can still go to the clerk and file the motion sending a copy to the pd and da. remember a ham sandwich will get indicted by a grand jury so having your lawyer present might not accomplish anything. he/she cannot talk or object during the grand jury proceeding. i would go to the pd office and demand help.
