Legal Question in Criminal Law in New York

forgery charges

requesting an attorney after being brought in for questioning I was brought to a cell and kept overnight and never was told what I was being charged with even after I asked the officer. The next day I was arrained for forgery. An ex-employer filed a complaint stating I took 2 estate checks and 2 of a clients checks payable to 2 different payees. I provided bank statements that provided info. that these deposits where never done. Can this employer make claim for checks not made out to them for resitution or does the payee file a claim? I've never been arrested before and the attorney appointed to me still has no answers and states that the DA has not provided any proof of discovery. The DA wants me to plea to one misdemeanor and probation. The DA has dropped 4 forgery charges but my lawyer state the their still prosueing over $2,000 in resistution even though I never received these funds and none of the checks where payable to this employer. Please help!! After this is sayed and done I plain on sueing this employer for false arrest and deafimation of character.

Re: forgery charges

It seems as if you would need help on various levels.

I would without question suggest hiring another attorney to assist you with the criminal case, from what you are saying it would seem asi you may have some defenses that are not being pursued.generally, these cases require payment in order for private attorney to assist you with.

If you are interested in filing a suit against the employer you may seek an attorney to assist you on a contingency fee basis, so you have no out of pocket expenses. However, if you plea guilty, or are found guilty, you will likely not be able to recover much in any suit... If anything.

If you are interested in pursuing such a suit you may also have a suit against the police for false arrest, such a case would need to be filed within 90 days of the arrest and would require an attorney filing a notice of claim for you with the city.thid would also be done for no out of pocket costs to you, on a contingency fee basis.

If you would like further assistance with these cases my office regularly handles all of the above types of cases, you may reach us at 212.709.8303 or 877.229.3394 and selecting to speak to me, carlos gonzalez.
