Legal Question in Criminal Law in New York

Hi,

my husband was arrested for Gang Assault (120.07) last June.

He was playing soccer at a nearby park with a few guys he knows. A man (informant) walked up to him and asked him if he sold any pot. He said no and told him to go away. The man then went some others guy that my husband knows from the park. Those guys started a physical fight with the informant about 100 feet from him. My husband tried to leave the park as soon as he saw the fight. A bunch of undercover cops then rushed in and pushed and kicked him down to the ground along with the guys who were fighting. Now they are all charged with the same charges as Gang Assault, assault with a deadly weapon and other charges. He was only in the facility and did not do anything wrong. We are hoping he will beat this case but very worried of what may happen. The guys wrote statements but my husband name was no where in those statements. Is there any other advice you can help us with???

Unfortunately, if things have gone this far, the only thing left to do is to make sure all the evidence in your husband's favor comes out at trial in front of a jury. If your husband did not participate in the assault and he did not know of any of the people involved, then it will go a long way towards helping him beat the charges. Other things that will be relevant are any additional witnesses: if he was playing soccer with anyone that knows him that was not involved in the assault, then that person can provide a good account of what happened. In addition, all the other people's statements that don't mention your husband will also help. For the most part, it is up to a good trial lawyer to get your husband acquitted.
