Legal Question in Criminal Law in New York

The judge sentenced me to 3 1/2 years in prison and never stated any term of post release supervision. I served the 3 1/2 years and somehow recieved a term of 5 years post release supervision, but no where on my sentencing minutes or commitment papers states the 5 years PRS. Can I sue?

If the Judge did not sentence you to a period of post release supervision at sentenceing, you can make a motion for resentencing. The Judge not DOCS has to sentence you to PRS.
