Legal Question in Criminal Law in New York

to the lawyer that answered my question about withdrawling my guilty plea before sentencing. no there is no written plea agreement and my lawyer is not doing anything for me. he is jus agreeing to anything the D.A is throwing at me. how do i go about withdrawling my plea agreement? i go to court on june 22nd and thats is when they are transporting me to the correctional facility. this is my first time getting into any real trouble and i am going to jail for something i am not guilty of. i also have proof that i was at an interveiw at the time of the crime. the other girl involved was at the residence at the same time i was and they dismissed her charges b.c she could prove she was at school at some point in the day. well i was at an interveiw when all of this happened so why cant i show the proof from the interveiw i was at and them drop my charges... none of what they are doing to me is making any sense and i cant see myself going to jail for a year over this. i have 2 small children and i have brought it to my lawyers attention that i would like to go to rehab for some of the time and they are telling me its not an option... someone please tell me what i can do i am running out of time........

If you can show you were innocent, then clearly your lawyer was not doing his job. You need a new lawyer to make a motion to withdraw the guilty plea.
