probation and medical issues

my son need medical treatment and

his probation offficer has not allowed

him to leave state to recieve it.. He

has never violated probation and has

gone o get treatment before and it

worked out fine help this is a matter

of life and death.

Under NY Penal Law sec. 65.10(3)(b), "when imposing a sentence of probation the court, in addition to any other [statutorily authorized] conditions ... shall require as conditions of the sentence that the defendant remain within the jurisdiction of the court unless granted permission to leave by the court or the probation officer...."

Thus, I would recommend contacting an attorney so he/she could explain either to the probation officer or the court why it is absolutely necessary for your son to leave the jurisdiction of NY state and, hopefully, get the necessary permission.
