Legal Question in Criminal Law in New York

Probation Violation after 14 years

A friend of mine recently got into an altercation which led to police questioning. An arrest was never made, instead they pulled his rap sheet and realized he was on probation from 14 years earlier. No recent arrests since then. He is currently in police custody. A refined individual though as a teen he served time of which the most recent sentence should have run concurrent. Probation dropped the ball and now want him to serve 1 1/2 -3 yrs. Mind you, he does not have pending charges with his recent altercation. Have you ever heard of such, after so many years have gone by? Please advise

No I have never heard of such a thing. It seems that the time may be estopped. He should see a lawyer right away to enforce his rights. I see that you are in NY and Maryland. As I am from NY, I should state that I do not speak for what the state of the law is in Maryland.

Good Luck.

It is highly unlikley in most Maryland courts that the matter would result in your friend serving additional time. The court will look at what the original charge was that he was put probation for, the seriousness of the offense and how long he was was put on probation.
