Legal Question in Criminal Law in New York

Proof of theft

I was recently terminated at work because 1200.00 was missing. I am not the only one who had access to the money. I did admit to seeing an envelope of money. But it had no where near 1200. in it. Maybe 120. Anyhow. I was asked aobut the money from a co-worker (who was in charge of the money) about where the money was. I told her her last I had seen it, it was in her desk. The next day I came in, was called into my bosses office and told I took the money and I was being fired. I never said once that I took the money. My boss would hear nothing of what I had to say. I sent an email to my bossed asking her to mail me my last check, she sent me something back detailing how much money was missing and that I had until the beginning of next week to return the money or they would file crimal charges. They still have my last pay checks,. Then yesterday I receieved another email, spelling out more money that was missing. Now totally over 1400. I have not has any contact with them since that fisrt email i sent. So my questions are...A. what type of proof do they need? B. Could she have taped our conversation in her office leagally?

Re: Proof of theft

They need enough proof to convince a detective that you committed a crime, and she could have recorded the conversation if she wanted to.
