Legal Question in Criminal Law in New York

Hello, I have a question regarding the second chance program. I was arrested for possession of marijuana in NY. I received a desk ticket. This was not the first time, It happened over 2 years ago. In the mail i received something in regards to the second chance program that will have my case dismissed and deleted from court records. My question is am i able to get the same result if i show up on my court date? What are the chances that the case gets dropped as opposed to having the misdemeanor on my record?

The first time they were required to adjourn and dismiss. The second time they are not required to dismiss, but you may still find a sympathetic prosecutor. Offering some treatment may change a un-sympathetic prosecutor, to a sympathetic one.
