Legal Question in Criminal Law in New York

I have a record of a DWI, Harassment charge and a controlled substance charge....I got a call today from my old job at the Arc and they want me back..Because of OMRDD they cant give me my job back cause of my record and i haven't been able to get a job for a year.. They said they would like to have me back and asked me to look into getting my record ex-sponged i would love to get this done so i can get back to work..

New York State does not have an expungment or sealing statute. Your record is yours and it can not be changed unless a court changes it or you get pardon by the Governor. That being said, you should look into getting a Certificate for Relief from Civil Disabilities. This document, issued by a Court of competent jurisdiction might give you a way out. You need to contact ARC to see if this would be acceptable to them.

To get this you will need an attorney who knows how to make an application to the court through the probation department to get you a certificate.
