Legal Question in Criminal Law in New York

School charges

My child was suspended for endangerment, weapons possession. A box cutter was found in her book back which was hanging in someone elses locker. When asked why she had it, she stated that the person that gave it to her wanted it back. The teacher stated that he felt something odd in her back pack when he went to the locker to gather her belongings. Is this considered endangerment and weapons possession?

Re: School charges

I do think that the school overreacted in this matter.

There is nothing per se wrong with a box cutter. You can buy it at any store.

Your daughter is entitled to a hearing before an impartial hearing officer.

Why you should participate in a hearing is that you don't want this event on her permanent record, and you want her to return to school as soon as possible.
