Legal Question in Criminal Law in New York

17 year old black male and white female on college campus consented to touching and minutes after female said stop and male stopped and later female called cops. Male arrested and charged with Forcible Touching (Class A Misdemeanor). DA would not grant ACD offered a violation .Should we accept a violation or go to trial? Male has no record. Male wants to enlist in Air Force. Would that hinder his chances for enlistment?
