Legal Question in Criminal Law in New York

Time Frame To Folow For Renewal of a Case

I was recently brought up on false charges of aggravated harassment- (2nd degree misdomeaner). It took almost 2 years to get my day in court. The judge dismissed the case because the ''so called victim'' committed perjury in his testimony. My question is can the DA's office file for renewal of the case and if so, what is the time frame they legally have to do so.

Thanks

Re: Time Frame To Folow For Renewal of a Case

Generally a case is dismissed wih or without prejudice. If dismissed with prejudice charges can not be refiled. Furthermore, your case may be outside of the statute of limitations given the length of time of prosecution.
