Legal Question in Criminal Law in New York

A new york city correction officer is having an affair with my wife. He has emailed me sexual fotos of them together. He has given her over30k in monies. She refuses to get a divorce. This man has contacted childrens services to investigate me to try and take my son. The price for having a future with my wife is her getting custody of my son. He is named in my familycourt papers to not be around my son during her visits. He has violaTED THIS CONSTANTLY, INTERNET prostitution is being practiced by her. Do I have a civil case or criminal case

First, internet prostitution is not a crime recognized by the Penal Law of the State of New York.

Second, You do not have a criminal case but you can bring up a case in Family Court for violation of a court order.

Third, you could have grounds for a change in custody although it might be a long shot without more information.
