Legal Question in Discrimination Law in New York

A friend was recently fired for submitting mail from a former employee into the inter office mail of his place of employment (NYU/Polytechnic University. the mail non threatening. It was addressed to the President's of NYU and Polytechnic (they have recently merged). It's content was about a hostile work environment and some questionable decision making by the person in charge. My friends union is going to arbitration to try to reinstate him but if that fails does he have a case/ He's 64 years old and there was a previous case about 5 years ago where the University tried unsuccessfully to fire him. Could there also be a retaliation case also? He can't do anything until the arbitration hearing is resolved but we're looking ahead in case he isn't reinstated. Could there be a case here?
