Legal Question in Discrimination Law in New York

National origin discrimination

I want to fid out if I have a case that I can take to court and what chances I have to win.

I have been working for a bank for the last year, and since I started, I have been the center of ''jokes''. The jokes start from my manager, but sometimes expand to the rest of the group. Lately, another senior member has made fun of my accent in front of everyone, and has made jokes regarding my national origin. The same person has made similar jokes for another co-worker that is not US born.

To tell you the truth I have gotten used to the abuse since I have been working for 7 years as a professional. However, I am not going to tolerate being passed for receiving more responsiblities, which that will lead to a promotion, since the same person that harasses me supports his ''budies'', US born friends, even though I have higher education, advanced degree, and more experience than they have! I am tired of just playing stupid! All I want is justice!

What will be the evidence that I will need if I decide to take the firm to court? Is this a case where I have to pay upfront for legal fees? Approximately how long will it take in NY city for a case like that to be heard in court?

Thank you in advance!

Re: National origin discrimination

You may have a case for discrimination based on national origin. As far as what evidence you may need to support your claim, this forum is not appropriate to discuss such details. Suffice to say that if your manager is the ring leader of the discrimination your claim improves. Our firm does work on contingency, i.e. no up-front costs to the client, depending on the case. You are welcome to call for a free consultation.
