Can I still sue The man who hit me?

Hello! On may 2004 I was driving down McDonald avenue in Brooklyn NY. it is a two way street with double solid yellow lines. I was well under the speed limit and was going around 25mph in a clrar morning day. A very old man proceeded to attempt a very fast U turn and crossed the double solid yellow lines hitting my car. He neglected to look at where he was going and was driving very irrationally. he was one hundred percent responsible for the accident and I suffered minor injuries..mostly in the neck area. I called the police for an accident report and the man begged me not to allow the police report. I told him if he would pay for the accident than I would not sue. I thought that was what he did but when I applied for car insurance recently The accident came up and as a result it doubled my monthly premium. I WAS OUTRAGED!!! even though new York is a no fault state... can I still sue him for the personal injuries and the increased insurance premium that is one hundred percent his fault? the liitations of three years does not apply because i just discovered that he lied when he said he would pay out of pocket.
