Legal Question in Elder Law in New York

fraud

dad got ill feb.06 will terminal illness and designated both brother and i poa. brother has issues with every member of family and has isolated all. though still goes to visit dad. also verbally abuses him. got dad to file police report. through the stages of illness brother coerced dad to sign new poa and change his life ins to himself as full beneficary.dad says he was fooled into verbally agreeing to this dad has paralasisi and cannot write. these documents have full forged sighnatures . what can i do? can i revoke these documents and how? please help.

Re: fraud

It sounds as if 1) someone may need to be appointed as guardian 2) you may need to commence a civil suit declaring the documents as fraudulently created and 3) ensuring that your father is cared for properly during this time. I recently had a case like this in Supreme Court-Queens County, although in that case the prinicipal had already passed on and we were in court to stop the heirs from getting the proceeds of the insurance policy which was also done fraudulently.
