Legal Question in Entertainment Law in New York

Legalities of Recording a Public Seminar

Hello,

I will be giving seminars on health, nutrition, fitness, and motivation at a gym in the area. I want to be able to record and sell the videos. What is legally required of me in order to make this a legal act?

Thanks,

Re: Legalities of Recording a Public Seminar

You will need permission of the owners of the gym, any parties with rights in the gym and the consent of any persons identified in the videos.

Should you like to discuss this or any other legal matter, you can e-mail me for more information about low cost face-to-face, on-line, or a telephone consultation with a lawyer in our office.

To add to the list of permissions provided by the previous commentator, if you display any visible trademarks or service marks (product brands other than belonging to you), use any music (other than commissioned for this project) or use any celebrity's name or likeness (in endorsements, etc.), you will need appropriate licenses. Once you had all the necessary rights cleared, you should register your copyright in the video tape recording and, possibly, any elements of the recording (such as printed materials, etc.). Get an IP/entertainment attorney to review your materials before undertaking the project or, at least, before distributing the work publicly.

The above reply is in the nature of general information, is not legal advice and should not be relied on as such.
