Legal Question in Entertainment Law in New York

Private golf membership assessments

Am I legally obligated to pay an assessment imposed by the club if they are unable to fulfill their capital responsibilities in September. This is assuming I am an active golfer in the club.

Re: Private golf membership assessments

If you signed a membership agreement, that will govern. If not, there may still be conditions of membership to which you are subject. However, if there is no governing document, you can't be required to pony up the assessment. Some clubs operate as LLCs with additional capital calls. If your club also has you as a member of the LLC and you are oobligated to contribute more capital, you would probably be obligated. In any case, if the club is having trouble, you may want to consider another club.
