Legal Question in Family Law in New York

My 2-year old daughter's biological father (who has only seen her 12 times since birth) has filed for full custody of her. This is because he does not want to pay child support. I have all my text messages showing the times he came to see her. Can I use that in court as evidence?

You should also file for full custody. If you have not yet filed for child support, you should also do that as well. You should contact a family law attorney if you require assistance preparing these petitions.
