Alimony Payments

I have been divorced and recieving maintence. I assumed full responsibility for my home. I have refinanced my home and my mortgage with one bank was paid or so I thought. I have had trouble with the bank which originally said my mortgage was paid in full only to find out the bank made a mistake and said I still owed monies. All the original documentation was sent back to me and I filed it with the county and I was told it was indeed paid in full. Now the bank wants their monies and my ex husbands lawyer has wriiten me a letter saying he is withholding my maintence until the matter with the bank is resolved and to his satisfaction because she says i have ruined his credit. This is not so because the bank has not said they are going to sue anyone. I want to a grievance letter to the Bar Association because if my former husbands lawyer is holding my maintence in escrow I will not be able to pay my bills or resolve this matter with the other bank. What are my legal rights. I have no money to pay for a new lawyer and I have not heard from my orginal divorce lawyer. Please help me!

It is improper for your ex to withhold funds from you without befefit of a court order. However, it sounds like you will need an attorney to help you unravel this mess.

You may wish to ask for assistance from the attorney who represented you in connection with the refinance. If you represented yourself in that legal transaction, without benefit of counsel, that this is an expample of being penny - wise and pound - foolish.
