Legal Question in Family Law in New York

Change of guardianship

I have just been given sole custody of my child. I want to name my parents as guardians in the event anything happens to me. When I divorced, my ex and I had joint custody.

What do I need to do to change the guardianship from his father(who no longer has joint custody with me) to my parents?

Re: Change of guardianship

There is a little bit of condusion here. YOU are the 'guardian' of your child and, if you pass away, the natural father of the children will succeed you and become the next 'guardian'.

Your question asks how he might be skipped in favor of your parents.

There are two ways: 1) a court order based on motion on notice or 2) an agreement to this succession of 'guardianship' by the father.

You are welcome to a consultation for no fee.
