Legal Question in Family Law in New York

My husband had an affair for 11 months. I found out about it in Dec. 2006. We have decided to work things out and not get a divorce. The problem is the ex-girlfriend. She is making our lives miserable. She started a website in my husbands name totally bashing him and it is mostly filled with lies. She repeatedly emails me even though I mailed her a letter asking her not to have any contact with me. My husband has an order of protection against her. I know that my husband is just as guilty as she is but we are trying to get beyond this affair and she will not stop writing letters to friends and clients, trying to destroy him.Is there anything I can do about her legally in regards to her being the third party in my marriage. Can she be sued as the adultress. I need some help because she is causing me physical and mental stress. Thank you.

You may be able to obtain an order of protection against her. Also, a criminal charge of harassment may be available.

You may need to contact your local police or District Attorney's office to file criminal charges against (you cannot do it in Family Court since there is no legal familial relationship). Or you can commence a civil suit against her for intentional infliction of emotional distress, invasion of privacy, etc.

An order of protection and related charges is only the beginning. There are a variety of options open to you, depending upon whether you want to spend some money, and depending upon your assessment of the ex-GF's state of mind and likely behavior.
