Legal Question in Family Law in New York

child custody

My wife and have been separated for 3 years. She walked out on my daughter and myself shortly after our baby was born because she wasn't ready to be a wife and mother. Although we have filed for, our divorce is not yet final and there is no formal custody arrangement. Recently my wife began dating and has had a new baby with her current boyfriend. She is now indicating that she would like to have our daughter live with her. I want my daughter to remain in my care. What do I do. Is it likely that my daughter will be taken by her mother?

Re: child custody

While it is possible for your wife to get your daughter, it is just as possible for you to keep her with you.

Get thee to a Lawyer PRONTO. A good family lawyer can help you put together the case for why the child should remain with you.

Do not hesitate, if you want to maintain residential custody, you need to start building your case now.

Good Luck.
