child support new york

my son is 18. has lived with me for 4 1/2 years. he just failed his senior year of high school. so he is out of school. moved back with his mother and she filed for child support immediately. my son is working full time at 9.00 per hour.

my ex has been remarried and divorced again and has several financial obligations pertaining to her second divorce. I am sure she wants my CS money to pay those bills. how can this be addressed in court hearing? he should be emancipated. I do not feel child support is warrented to her unless she can show proof of specific cost for an 18 year old. need advice on how to fight this case in new york.

You need to demonstrate that your son is working full time at $9.00 an hour. I would subpoena his work records, check stubs, and W-2 if issued. Over 18 and working full time is an emancipated adult.
