Legal Question in Family Law in New York

What is considered the start date of a divorce

For equitable distribution purposes what is considered the start date of a

divorce? For example if my spouse filed on March 1, 2006, would my pension

amounts etc... be frozen on that date for distribution purposes or would any

money I contribute after that date be subject to equitable distribution? Also...

why would my spouses attorney make a discovery request for four years of bank

statements and credit card bills? Does it matter what I spent my money on in the

past and why? I'm not self employed so this is very puzzling and seems like a lot

of work.

Re: What is considered the start date of a divorce

While the commencement date of the action is often used as a cutoff point, the trial court has discretion in these matters. Asking for several years back information is common and is used to determine whether or not there has been marital waste, hidden income, etc.
