Legal Question in Family Law in New York

costodial parent moving out of state

I would like to move out of state with my 13 year old daughter. At what age will it actually be legal for us to leave. Her father lives approximately an hour away, and won't be too happy. My family has moved south and we would very much like to be with them

There is no per se age to allow you and your child to move out of state. The Court looks toward the best interest of the child. If the father is only an hour away and has a relationship with his daughter, the Court is not likely to allow you to move with the child out of New York.
