Legal Question in Family Law in New York

Custody

I have been in a ''common law'' relationship with a woman for 3 years. When we met she had two children from her marraige. 10 months ago we had a child together. The relationship is failing. Is it possible for a father to get custody when it will involve seperating brothers. The two sons of this woman are 10 and 11, and my son is 10 months old.

Re: Custody

The test is the best interest of the child. Several factors are considered when making this determination. It is not possible to give you a definitive answer without discussing all the facts.
