custody of son

if my ex wife kicks out my son and tells him to live with me, can i legally do this if she changes her mind?

How about some more information such as:

How old is the child? Do you share custody (even if not residential)? What were the circumstances behind her action?

If you are serious about changing his custody, go to Family court in the morning and make a motion to do so.

You should petition the court for custody of your son so that she can not randomly change her mind. Depending on the age of your son his wishes will be taken into consideration. If she doesn't want him to live there anymore then you should not have major problems. Your case sounds like a comparative fitness case unless you can prove that she is unfit.
