Legal Question in Family Law in New York

My daughter is 7 months old and her biological father has had nothing to do with her for more than 5 months, that is after he threw us into the street in the middle of the night. How can I make my partner the legal guardian of her, as he is truly her dad in spirit and love?

There is not enough information to answer this question, but based on the information you have provided, you would have to get the biological father's consent to make your partner your daughter's legal guardian. And absent him being incarcerated, a danger to his child or some other egregious offense making him an unfit parent, you will have to get his permission first.
