Legal Question in Family Law in New York

My daughters father wants full custody of our 9 year old daughter just because i took him to child support. he has not served me any papers and the court nor him have sent me a letter. if the date for the court comes and i wasnt served or mailed any letters and dont know when the court date is, can the court still give me a warrent for not showing up or will they just dismiss the case because i didnt get served?

You must be served with the papers regarding the custody matter unless you refuse service.

If your child's biological father claims that you refused service he will have to provide the court with proof that you refused service.
