Legal Question in Family Law in New York

divorce decree states who pays for bill

married form 1999 to 2001 when she left and joined army. During time of marriage and I was in Navy, she had power of attorney and she was underage. She went to Navy and got a load for car and signed my name. She filed for divorce and in the decree it is stated she would pay that money back. She didn't pay and now they are coming after me. I sent copy of divorce to collection agency and they said I am still responsible, to take her to small claims court. She is remarried and living on army base so I can't. Aren't they supposed to collect from her? If I pay I will never get money from her as she's down south. What can I do to get them off my back and go after her? Thank you--name removed--Sutton

This stinks - but it is the law.

The divorce settle ment does not relieve you of the debt, it only gives you a right of indemnification. the right to make her pay you back.

However, just because she is 'down south' does not mean that you cannot sue her in NY and have her assets seized.
