No Divorce
My husband has remarried without benefit of divorce as far as I know. He passed away recently and I need to know what is legally mine as his current 'wife' is not really his wife.

As the spouse you have the right of election. Generally, the right of election is a complicated law which is designed to protect a surviving spouse from being disinherited.
