Divorce and Inheritance

my mom just passed away and left me the apartment, car, and some money. I am filing for divorce. Is my husband entitled to anything from the inheritance. we have no other property together and been married for 8yrs.

My sincere sympathies on the loss of your Mother.

Make sure you do NOT co-mingle anything with your sooon to be ex-spouse. Don't sell anything and put it in a joint account , etc.

Inheritance, THAT IS KEPT SEPARATE, is not marital property.

Whatever you inherit will be your separate property.

Under almost all circumstances, in New York an inheritance is not divided in a divorce settlement, but remains the individual property of the person who received it.
