Legal Question in Family Law in New York

My aunt and uncle lived in NY all their lives. 3 years ago they moved to Florida. My aunt wants to separate and file for divorce because my uncle will not return to NY even though he said he would in 2 years if my aunt did not like Florida. Where would she file for divorce? She is now in NY staying with family - is that abandonment?

Go to this site and click on the link for divorce forms from New York State fromartzlaw.com/links.htm

Once she has lived in New York for more than a year she can file in New York. If he has refused to follow through with their plans it can be called abandonment. If he tries to fight the divoce she will need a lawyer in order to complete the process.
