For a divorce in New York, the court must account for child support. If you have a prior Family Court Order, the Judgment of Divorce would reflect the prior Order. If there is no Order concerning child support, you would have to calculate the child support obligation to obtain a divorce. Once calculated, the parties would have the option of either complying or opting out of the child support calculations.
