Divorce

I got married to a non-citizen on 12/2004. She has since had a child by someone else. I have not seen her in the past 18 months. I have no idea where she is. I want to divorce her. We have no children togther? I have no idea how to get in touch with her. It is possible that she was seported. Her Temporary visa has sinced expired. What can I do? to get the divorce?

It is possible under, some circumstances, to deliver notice to a spouse who has disappeared by publication. However, even if you get proper service by publication - in New York you need grounds for a divorce.

You should consult a competent matrimonial attorney to work out the specifics of your situation.
